1. What you're actually doing here
When you hand us $30, you are making a voluntary donation to support the development of software. You are not purchasing a product in any legal sense that would entitle you to support, warranties, updates, refunds, legal recourse, a shoulder to cry on, or any form of ongoing relationship with us whatsoever.
In exchange for your donation, we will let you download a macOS application. That's it. That's the whole deal. We feel this is extremely fair and possibly even generous.
2. The software is provided AS IS
These applications are provided "as is", which is a legal term meaning "exactly how they are, with no promises about anything." This means:
- We make no warranty that the software will work on your machine.
- We make no warranty that the software will continue to work after a macOS update.
- We make no warranty that the software won't do something unexpected.
- We make no warranty about anything, full stop, end of list.
The software has been tested and works on our machines. Our machines are Macs running macOS on Apple Silicon (arm64). If your setup differs from this in any way, you are in experimental territory and you entered it voluntarily.
3. No refunds. Not one. Ever.
We do not issue refunds. This is not a surprise, you've now read it in the hero section, the product cards, the deal rules, and here again in the legal document. If you donate and then decide you don't like the software, that is the nature of a donation. You don't get your church collection back either.
The only exception we will make is if we are legally compelled to by a court of competent jurisdiction, at which point we will comply with the court order while being extremely grumpy about it.
4. macOS arm64 only
These applications run on macOS on Apple Silicon only. They do not run on Windows. They do not run on Linux. They do not run on Intel Macs. They will not run on these platforms in the future. This is not a bug. This is a choice. A choice we made, and we are at peace with.
If you donate and then discover you have a Windows machine, that is unfortunate but also something you could have checked before donating. We did mention it. Several times. In large text.
5. No support
We do not provide technical support, customer service, onboarding assistance, training, documentation beyond what's in the app, bug fix timelines, feature request responses, or any other form of hand-holding. We have lives.
You are welcome to send us a question that isn't support-related. If you send us a support request, we will read it, feel mildly guilty, and then not reply.
6. Future versions
If we release an updated version of the software, you are not automatically entitled to it. A donation covers the version that exists at the time of donation. Future versions are a separate donation. This is not a subscription model dressed up in new clothes, there genuinely may never be a future version, or there might be one next week. We don't know. We're just people with computers.
7. Virus-free, but still
These applications do not contain malware, viruses, spyware, adware, ransomware, or any other kind of -ware that isn't the software you downloaded. We have no interest in your data, your files, your microphone, your webcam, or anything else on your computer. We just want you to stop giving money to Mailchimp.
That said, you install and run software at your own risk. That's true of all software. That includes software from large, well-funded, legally-lawyered companies. We're just being more honest about it than they are.
8. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the software.
In plain English: if something goes wrong, we're not paying for it. Our total liability to you, under any circumstances, shall not exceed the amount of your donation. Which was $30. Just so you know where we all stand.
9. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales. If you disagree with this, you are welcome to not donate.
10. Changes to these terms
We may update these terms occasionally. When we do, we'll update the date at the top. If you've already donated and downloaded, these terms don't retroactively change what you got. You got the software. You still have the software. We're still not giving you a refund.
